摘要：因为《学前教育法》的长期缺位,我国学前教育事业的发展事实上是由学前教育政策进行规范、引导的。但是政策与法律之间的区别决定了仅有学前教育政策难以满足实践的需要,学前教育立法有其必要性。与此同时,政策与法律之间又有着密切的关系,这一关系使得《学前教育法》的制定离不开对现行学前教育政策的观照,由此学前教育立法具有浓厚的政策法律化色彩。通过政策法律化而由《学前教育法》进行回应的问题主要包括学前教育服务的对象、学前教育的地位与性质、学前教育的财政保障、学前教育的管理体制、幼儿园及其工作人员、学前教育的内容及开展、学前教育的监督与问责等几点。Because of the absence of Pre-school Education Law for a long time,the development of preschool education in China is actually regulated and guided by pre-school education policies. However,the difference between policies and law determines that only pre-school education policies cannot meet the needs of practice,and the legislation of pre-school education is of necessary. At the same time,there is a close relationship between policies and law,which makes the promulgation of the Pre-school Education Law inseparable from the consideration of the current pre-school education policies,through which the legislation of pre-school education has a strong color of legalization of policies. Specifically,the questions answered by the Preschool Education Law through the legalization of the policies,mainly include the object of the pre-school education service;the status and nature of pre-school education;financial guarantee of pre-school education;management system of pre-school education;kindergartens and their staff;Content of pre-school education and its development;supervision and accountability of pre-school education,etc.
