我国学前教育法律体系的现状、问题及优化路径

摘要:从行政干预走向法律规制,学前教育科学立法不可或缺.公共性是学前教育的基本属性,维护和提升学前教育的公共性是学前教育的立法宗旨.基于公共性的考虑,学前教育立法的原则包括:维护学前教育公益性,防止负的外部效应;维护学前教育公平性,保障儿童的基本消费;体现学前教育理性,符合儿童发展规律;维护学前教育自由性,建立多样态、多层次、多阶段的学前教育机构体系;尊重两类学前教育机构的差异性,促进公共性与自主性的协调.From administrative intervention to legal regulation, scientific legislation of preschool education is indispensable. Public nature is the basic attribute of preschool education. Maintaining and promoting its public nature should be the purpose of preschool education legislation. Based on the consideration of public nature, the principles of preschool education legislation include: maintaining the public welfare of preschool education and preventing negative external effects, maintaining the fairness of preschool education and guaranteeing the basic consumption of children, embodying the rationality of preschool education and meeting the criterion of children development, safeguarding the freedom of preschool education, establishing system of preschool education institutions with multi-state and multi-stage, respecting the differences between two kinds of preschool educational institutions and promoting the coordination of public nature and autonomy nature.
